This Refund & Cancellation Policy outlines your rights and the applicable refund conditions.
⚠️ Important Note on Statutory Government Fees: Statutory fees remitted directly to government authorities (MCA, ROC, GST Portal, Income Tax Department, Trade Marks Registry, Stamp Duty offices) are strictly non-refundable once challans are generated or paid to government accounts, as government departments do not entertain refunds.
1. Service Cancellation Policy
You may request cancellation of an order under the following circumstances:
- Cancellation Before Work Commencement: If you request cancellation within 24 hours of payment and before our team has begun drafting documents, name approval filings, or DSC generation, you are eligible for a 100% refund of the professional fee (subject to deduction of nominal payment gateway transaction processing fees, typically 2-3%).
- Cancellation After Work Has Commenced: If our legal/accounting team has already verified documents, completed preliminary drafting, or conducted name availability searches, an administrative charge proportionate to the work completed (minimum ₹500 or 25% of the professional fee) will be retained, and the remainder of the professional fee will be refunded.
- Cancellation After Government Submission: Once filings have been submitted on government portals (e.g. SPICe+ Part B submitted, GST application ARN generated, or Trademark form TM-A filed), no refund of professional fee or government fee shall be admissible as the service has been executed.
2. Deficiency of Service & Resolution Guarantee
If an incorporation or statutory filing encounters an error solely attributable to an oversight or clerical mistake by LegalPehchan:
- We will rectify the filing or resubmit the required documentation at zero additional professional cost to the client.
- If we are unable to resolve the deficiency through our professional fault, the client shall receive a full refund of the professional fees charged for that specific task.
3. Non-Refundable Scenarios
Refunds shall NOT be granted in the following situations:
- Government Rejections due to Non-Compliant Client Records: If an application is rejected by government authorities due to defective, forged, or unverified documents provided by the client (such as invalid electricity bill, mismatch in Aadhaar/PAN details, or signature issues).
- Trademark Examination Objections: Rejection or objection raised by the Trademark Registry based on existing registered marks or descriptive terms is a natural legal risk and does not qualify for a refund of government or drafting fees.
- Client Non-Responsiveness: If the client fails to provide mandatory documents, OTPs, or signatures for more than 45 days after payment, the service case will be marked on hold and fees shall be non-refundable.
- Government Regulatory Delays: Extended processing time caused solely by government portal outages (MCA V3, GSTN) or government officer delays is beyond our reasonable control and does not qualify for a refund.
4. Refund Request & Processing Timelines
To request a refund or order cancellation, please follow these simple steps:
- Send an email to contact@legalpehchan.com from your registered email address with the Subject: "Refund Request - [Your Order/Lead ID]".
- Include your registered mobile number, the service name, transaction proof, and a brief description of the reason for cancellation.
- Our customer grievance team will review your request within 2 business days and communicate the status.
- Once approved, refunds will be credited back to your original source of payment (Bank Account, Credit/Debit Card, or UPI) within 5 to 7 business days in accordance with standard RBI payment gateway settlement cycles.
